Factual Allegations

In 2022, John Doe, a personal trainer from California, was invited by a fashion designer client to an exclusive awards show after-party hosted by Sean Combs at his Hollywood Hills residence on June 27, 2022, after Combs saw videos of Doe’s workouts. A black Lincoln Navigator escorted Doe to the event, where he signed a nondisclosure agreement and was given a drink laced with GHB by a Combs associate as a condition of entry. Inside, Doe felt at ease seeing a familiar client, but was soon led to a smaller room with group-sex activities. Feeling disoriented from the drug, Doe was assaulted by Combs, who performed non-consensual oral sex on him, then forced him to do the same to Celebrity A, who spat in Doe’s mouth. Drugged and unable to resist, Doe was passed around for sexual acts by multiple attendees, losing consciousness intermittently. He awoke outside his apartment, shirtless and phoneless, with no memory of how he got there, suffering severe trauma, financial loss, and livelihood damage.

Prayer for Relief

Plaintiff seeks: (a) compensatory damages for physical injuries, emotional distress, psychological harm, anxiety, humiliation, pain and suffering, family and social disruption, and other harms, in an amount to be determined at trial; (b) punitive damages in an amount to be determined at trial; (c) attorneys’ fees and costs under applicable statutes; (d) pre- and post-judgment interest on damages, fees, and costs; (e) attachment of Defendants’ real property and assets in New York per Federal Rule of Civil Procedure 64; and (f) any other relief the Court deems just and proper.

Mar 12, 2025 53 ORDER with respect to 50 Motion to Dismiss. On March 11, 2025, Defendants filed a motion to dismiss the complaint under Rule 12(b) of the Federal Rules of Civil Procedure. Under Rule 15(a)(1)(B), a plaintiff has twenty-one (21) days after the service of a motion under Rule 12(b) to amend the complaint once as a matter of course. Accordingly, it is hereby ORDERED that Plaintiff shall file any amended complaint by April 1, 2025. Pursuant to Local Civil Rule 15.1, available at https://www.nysd.uscourts.gov/rules, any amended complaint should be filed with a redline showing all differences between the original and revised filings. Plaintiff will not be given any further opportunity to amend the complaint to address issues raised by the motion to dismiss. If Plaintiff does amend, by three (3) weeks after the amended complaint is filed, Defendants shall: (1) file an answer; (2) file a new motion to dismiss; or (3) file a letter on ECF stating that they rely on the previously filed motion to dismiss.
