Doe v. Combs et al

On September 7, 2000, Jane Doe, a 13-year-old from Alabama, was dropped off at Radio City Music Hall in New York City to attend the Video Music Awards (VMAs) but, lacking a ticket, sought entry to an afterparty. She convinced a limousine driver claiming to work for Sean Combs, who said she fit Combs' preference for younger girls and drove her to a large white house after she signed a non-disclosure agreement. Inside, amidst celebrities and drug use, she consumed a reddish-yellow drink that made her woozy, later identified as laced with GHB. Seeking rest in a bedroom, Combs and two celebrities (Celebrity A and Celebrity B) entered; Combs aggressively threw her to Celebrity A, who raped her vaginally while Combs and Celebrity B watched, followed by Combs raping her. She resisted oral sex, fled the room naked, dressed outside, and reached a gas station to call her father, suffering lasting depression from the trauma.

Plaintiff seeks: (a) compensatory damages for physical injuries, emotional distress, psychological harm, anxiety, humiliation, pain and suffering, family and social disruption, and other harms, in an amount to be determined at trial; (b) punitive damages in an amount to be determined at trial; (c) attorneys’ fees and costs under applicable statutes; (d) pre- and post-judgment interest on damages, fees, and costs; (e) attachment of Defendants’ real property and assets in New York per Federal Rule of Civil Procedure 64; and (f) any other relief the Court deems just and proper.

Plaintiff Jane Doe voluntarily dismissed the action with prejudice pursuant to Rule 41(a)(1)(A)(i) of the Federal Rules of Civil Procedure, with the consent of counsel for each Defendant.
