Dewitt Gilmore v. Sean Combs
In the summer of 1996, DeWitt Gilmore was assaulted by Sean Combs and his associates, including a bodyguard, on a New York City street after exiting a club. Gilmore, accompanied by friends Lance Calfe and Rico, approached his parked Isuzu Trooper when Combs, in a gold convertible with his bodyguard driving, initiated a verbal confrontation with derogatory and threatening language. The situation escalated as Combs' armed associates in additional vehicles surrounded Gilmore’s car, brandished firearms, and fired shots. Gilmore and his friends fled through traffic, narrowly escaping. Gilmore suffered emotional and psychological distress, fear of retaliation, and reputational harm but delayed filing due to Combs’ influence and fear of retribution. In September 2024, Gilmore reconnected with witness Lance Calfe, whose corroborating statement provided new evidence to support this filing.
Plaintiff seeks $5,000,000 in compensatory damages for emotional distress, physical harm, lost opportunities, and reputational damage; punitive damages to deter future misconduct; costs of the action, including reasonable attorney’s fees; and any other relief the court deems just.
Defendants' motion to dismiss is granted, and Plaintiff's motion for leave to amend is denied. The Court certifies that any appeal from the order would not be taken in good faith, denying in forma pauperis status for appeal purposes, and the case is closed.
