See S.D. Fla. L.R. 7.1(a)(3). On the other hand, the duty to confer is reciprocal; opposing counsel must "cooperate and act in good faith" in effort to resolve their disputes. Id. Moreover, the pre-filing conference requirement is not limited to opposing counsel, but also extends to "all parties or non-parties who may be affected by the relief sought." Id. Movant has not certified that he attempted to confer with all affected parties. Failure to comply with Local Rule 7.1(a)(3) is an independent ground on which the Court may deny the Motion. See id. Accordingly, Daniel Bober's 148 Motion for Protective Order is DENIED, without prejudice to renew following appropriate conferral.The Parties are further advised that entry of a protective order requires a showing of good cause. By imposing these conditions, the Local Rule discourages last-minute continuance requests that advance unsubstantiated bases to delay court hearings.Javon Hadley's 418 Motion represents that he has an unmovable and unexplained work conflict preventing his appearance at the hearing scheduled for Friday, May 22. Mr. Hadley is of course welcome to attend the hearing, but his personal appearance is not required. His unavailability does not establish exceptional circumstances that would warrant a continuance. The Motion further represents that the attorney who has represented him in criminal matters, but who is not counsel of record in this case, has a conflict and also cannot appear. According to the docket in that case, see Case No. 1:25-cr-20146-EA, the conflicting hearing was set more than two months ago. Further, the May 22 hearing in this action was set on April 16, more than one month ago. See (ECF No. 370). Hadley's election to wait until two days before the discovery hearing to seek its continuance is a further violation of the Local Rule. As noted in my Order of April 16, 2026, the bi-weekly hearing schedule was established in this case as a result of the Parties' inability to engage in good faith efforts to resolve any of their discovery disputes without court intervention.
