In May 2001, Plaintiff Jane Doe met Sean Combs in an elevator at 157 West 57th Street, New York, NY, where he invited her and her friends to a party. Combs obtained her phone number and later that day invited her to a club. On their first night out, Combs complimented her appearance, initiating a grooming process. On a second occasion, at Bad Boy Records' studio in Manhattan, Combs attempted to kiss Jane Doe in an SUV, which she rebuffed, prompting him to yell at his bodyguard for looking. On a third night in July 2001, after visiting the studio, Jane Doe and her friend were rushed out of a club due to a commotion and driven to Cafeteria restaurant at 119 7th Avenue, NYC, where they left without informing Combs, angering him. On July 31, 2001, Combs invited Jane Doe to the Bowery Ballroom for a Mos Def performance. At the studio, they boarded a tour bus with 8-10 imposing men, observing condom wrappers and underwear. After the concert, Combs took Jane Doe to his apartment at 807 Park Avenue, where he forcibly led her to his bedroom, locked the door, and sexually assaulted her despite her protests, pinning her down and threatening her. Jane Doe escaped to the bathroom, then fled the apartment. Combs later called her repeatedly, but she did not respond, suffering significant emotional trauma and requiring six months of psychotherapy.
