In Combs v. NBCUniversal Media, LLC, Peacock TV LLC and Ample, LLC, Index No. 151935/2025 (N.Y. Sup. Ct., N.Y. Cnty.), the defendants’ lawyers on Oct. 16 submitted a proposed judgment that would make Sean “Diddy” Combs pay $477,700.50 in attorneys’ fees, with 9 percent annual interest and immediate execution. The docket now lists a judgment signed by the court and sent to the County Clerk. A day earlier, Combs’s own lawyers at Sher Tremonte LLP filed a letter backing their pending request to withdraw. (ECF Nos. 172–175.)

The Proposed Judgment

Justice Phaedra F. Perry-Bond awarded the fees on Oct. 6 under Civil Rights Law § 70-a, about 48 percent of the $990,292 the defendants had sought (see Dispatch 17). Her order directed defense counsel to “submit a proposed judgment to the Court reflecting the $477,700.50 awarded” within ten days of entry. (ECF No. 170 at 8.) Gibson, Dunn & Crutcher LLP filed the proposal on Oct. 16.

The three-page document recites the case’s history from the Feb. 12, 2025 complaint through the Oct. 6 award. Its operative paragraph would order that NBCUniversal Media, LLC, Peacock TV LLC and Ample, LLC “shall recover from Plaintiff Sean Combs” the $477,700.50, “with post-judgment interest on such total sum accruing at the statutory rate of 9% per annum from the date of entry of this judgment through the date of payment and satisfaction of judgment, and that Defendants have immediate execution thereon.” It lists Combs’s address, “upon information and belief,” as the Federal Correctional Institution at Fort Dix, N.J. The lines for the judge’s signature and the clerk’s entry are blank. (ECF No. 173 at 1–3.)

In a supporting affirmation, defense partner Connor S. Sullivan states that the proposal seeks the $477,700.50 and that the defendants “are not seeking costs or expenses in this action.” (ECF No. 174 ¶¶ 2–3.)

A Signed Judgment, Not Yet Posted

The docket entry for the judgment, ECF No. 175, describes it as signed by the court and sent to the County Clerk. It carries no filing date, and no document has been posted with it. Whether the court adopted the proposed terms, including the interest rate and immediate execution, cannot be confirmed until the signed judgment appears.

Sher Tremonte’s Letter

On Oct. 15 Sher Tremonte lawyers Michael Tremonte, Erica Wolff and Benjamin J. Shack Sackler wrote to Justice Perry-Bond about the firm’s application to withdraw as Combs’s counsel, which the court set for submission on Oct. 23 with no appearance. They call to the court’s attention, “as supplemental authority,” Judge Valerie Caproni’s Oct. 13 decision in Kelly v. Combs, which they say “granted Sher Tremonte LLP’s motion to withdraw as counsel in a similar matter involving Mr. Combs” and granted a retaining lien “pending submission of supporting documentation.” The letter quotes Judge Caproni as agreeing that Combs’s “lack of payment and the breakdown in attorney-client relationship ‘are sufficient to justify Sher Tremonte’s withdrawal.’” The decision is attached. (ECF No. 172 at 1; see the earlier Dispatch.)

The firm’s underlying motion says Combs “has deliberately disregarded his obligation to pay Sher Tremonte’s legal fees and expenses” (ECF No. 167 at 2; see Dispatch 16). Those are the firm’s statements, not findings. The docket shows no answering papers on the motion.

What Remains

The court has not ruled on the withdrawal motion. The signed judgment is awaiting its posting and entry. Combs’s appeal of the April 20 dismissal (No. 2026-03017) is pending in the First Department.
